Carla Vicente presents the book “Noção de Jogo-Consequências Jurídico-Práticas”

It is next Saturday, March 11th, at 4:30 pm, that the Casino Estoril Art Gallery will host the presentation of the book “Noção de Jogo-Consequências Jurídico-Práticas”, by Carla Vicente, Legal Advisor to the Ombudsman.

Carla Vicente will present her work, recently published by GESTLEGAL, having also invited a distinguished panel of speakers to analyze the book and debate the moment in the gaming sector at the national and international levels.

In addition to Carla Vicente, author of “Noção de Jogo-Consequências Jurídico-Práticas”, the panel will also be composed of António Vieira Coelho, Executive Director of Estoril Sol; Jorge Godinho, Professor at the University of Macau; Alexandre Miguel Mestre, of Abreu Advogados; and André Folque, Deputy Attorney General, Member of the Advisory Board of the Attorney General’s Office.

Faced with the observation, on the one hand, that the boundaries between gambling and new leisure activities are increasingly blurred and, on the other hand, that typical games of chance have been changing in order to adapt to the new generations, more attracted by skill and interactive games, the author focuses, in this work, on what is, what has been and what can be considered Game. The answer to this question is all the more important if we bear in mind that the illicit exploitation of gambling is a crime.

The author argues that, in these new leisure activities, from the moment monetary amounts are involved, mechanisms similar to those of responsible gaming should be created, such as the possibility of self-limiting the number of monetary amounts to be spent and self-exclusion.

As for the game itself, if it was previously completely prohibited because it was considered an immoral activity and even a sin, where easy fortune was sought through luck and kept players away from fulfilling their work and family duties, from the moment that this immoral charge has been dissipating, it is increasingly seen as a leisure activity that needs to be regulated and contained to the extent necessary, in order to avoid potential excesses and crimes, that is, namely due to the need to protect players.

It seeks to explain the reasons for this evolution and understand the current limits of Gaming Law, which required confrontation with skill activities, with sports and video game competitions (Esports), through fantasy sports, the phenomenon of monetization of video games (namely loot boxes) and the tendency gamification of traditional games of chance translated, namely, into the emergence of slot machines with elements of skill.

With a degree in Law and a post-graduate degree in Administrative Law and European Union Law, Carla Vicente has specialized, over the last twelve years, in Gaming Law, namely with regard to the protection of players and the adoption of a responsible gaming policy. As Legal Adviser to the Ombudsman in Lisbon, Portugal, she analyzes complaints from players and employees of the gaming sector against gambling operators, as well as against the Regulatory Service (SRIJ), and even against applicable legal provisions.

Carla Vicente is also a speaker at courses, and conferences, and a trainer in Child Safety/technical standards, cultural heritage, urban law in general, expropriations and easements, sports and games of chance, having taught classes in the Gaming Law Course Fortuna e Azar, at the Faculty of Law of Universidade Nova de Lisboa and practical classes in Community Law at the Faculty of Law of the University of Lisbon. She has already published a book, as well as several articles in the area of Administrative Law and the European Union.
